Adultery is no longer a crime, but it will continue to be grounds for divorce. A petition was also filed for the scrapping of the law as it treats men and woman unequally. Rather, we prayed that only Section 198 of the Code of Criminal Procedure, 1973, which prohibits wives from filing adultery complaints, be struck down.

Critics of the law said it discriminated against women by characterising them as nothing more than their husbands' property, but others fear the new ruling will promote licentiousness. The Impugned Provisions violate Article 15 of the Constitution of India and can not be accorded any protection under Article 15 (3).

The ruling to decriminalize adultery had been strongly opposed by the government of Prime Minister Narendra Modi, whose center-right coalition is led by the Hindu-nationalist Bharatiya Janata Party, or BJP.

Delhi Commission for Women (DCW) chairperson Swati Maliwal on Thursday criticised the striking down of the British-era adultery law by the Supreme Court, saying that the decision is tantamount to extending "open licence" to cheating among men.

One is working in the sphere of the criminal law and the SC has said that adultery is not an offence. The Allahabad High Court had said that only wives not guilty of adultery can use this concept, and not wives who are in fact guilty.
