United States judge dismisses Manafort's civil case over Russian Federation probe

United States judge dismisses Manafort's civil case over Russian Federation probe

The court refused to satisfy the civil suit of the former head of the electoral headquarters of Donald trump Paul Manafort who tried to challenge the authority of the special Prosecutor for the investigation of the Russian intervention in elections in 2016.

In her decision, U.S. District Judge Amy Berman Jackson wrote that a civil suit is not the way for Manafort to challenge actions by the prosecutors who are working for Mueller's office.

In separate actions, Paul Manafort has moved to dismiss criminal charges he is scheduled to face in D.C. court in September and other federal tax-related charges he is scheduled to face in an Alexandria courtroom in July.

In the memo, Deputy Attorney General Rod Rosenstein specifically stated that it was within the special counsel's scope to investigate payments Manafort received from the Ukrainian government before and during the tenure of the country's Russia-backed former president, Viktor Yanukovych.

Manafort, 69, has pleaded not guilty to felony charges related to his work as an global political consultant in Ukraine before joining Trump's campaign in March 2016. The lawsuit claimed that Rosenstein granted Mueller too much authority, and that Mueller acted beyond his mandate.

In Friday's filing, Jackson said that a civil case was "not the appropriate vehicle" for Manafort's concerns about "what a prosecutor has done in the past or where he might be headed in the future". She noted in her ruling Friday that her opinion on this lawsuit shouldn't be read as her opinion in the criminal case.

Rosenstein's order appointing Mueller makes clear that the special counsel is authorized to investigate and prosecute Russian meddling in the 2016 election, potential links or coordination between Trump campaign associates and the Russians, as well as "any matters that arose or may arise directly from the investigation".

Rosenstein took over the special counsel investigation previous year after U.S. Attorney General Jeff Sessions recused himself from matters related to the President Donald Trump campaign. "Therefore, the court finds that this civil complaint must be dismissed". Jackson said Manafort has an "adequate remedy at law in the form of his pending motions to dismiss or future motions to dismiss". In addition, Manafort is also being prosecuted for his failure "to register as a foreign agent in connection to work he did" for the former president of Ukraine, Viktor F. Yanukovych, who is known to be a close associate of President Vladimir V. Putin of Russian Federation. She appeared skeptical of Manafort's challenge during a hearing earlier this month in Washington federal court.

The Justice Department had asked for the lawsuit to be dismissed.
