Triple Talaq: Woman seeks justice, threatens to convert to Hinduism

The board has chose to end the practice of triple talaq itself in one-and-a-half years so the government should not interfere in the matter, ' Shiv Sena mouthpiece Saamna quoted Vice president of AIMPLB, Dr. Sayeed Sadiq as saying.

Nikah halala requires a divorced Muslim woman to marry another man, consummate the marriage and divorce him if she wants to remarry her earlier husband.

Sadiq said that the Muslim Community provided talaq in such a way that the girl lives respectfully in the society, adding that it just needs some time to take a decision on the issue.

Sources said the Chief Minister told them that his government will present to the court the views of Muslim women on the triple talaq.

It said the practices under challenge - "namely triple talaq, nikah halala and polygamy" - have an "impact (on) the social status and dignity of Muslim women and render them unequal and vulnerable" and "deny".

A number of Muslim women have filed petitions to quash the practice of triple talaq and polygamy.

"The conferment of a social status based on patriarchal values or one that is at the mercy of menfolk is incompatible with the letter and spirit of Articles 14 and 15", it said. She said that if she does not get justice for herself and her daughter she would have no choice but convert to Hinduism. The submissions drawn by advocate Madhvi Divan have been settled by Attorney General Mukul Rohatgi. "So, we will try to attain justice in this", the Union Minister said.

"The paradox is that Muslim women in India are more vulnerable in their social status because of the prevalence of such practices, even though they live in a secular country", it said. "It is submitted that the practice of polygamy is a social practice rather than a religious one and therefore would not be protected under Article 25", the counsel added, contending that this was "true also of nikah halala and triple talaq".

In its manifesto for the assembly polls, the BJP had promised to take up the triple talaq matter.

The vice president of All India Muslim Personal Law Board, Dr Sayeed Sadiq, on April 11 said that it would do away with the controversial practice of triple talaq in 18 months.
